Trademark Opposer Concedes SSJR Motion to Dismiss

SSJR obtained an early dismissal of a trademark opposition challenging the registration of the mark FAMILYSLEEP. Several parties commenced the opposition alleging that the mark was a descriptive term. SSJR moved to dismiss the opposition, asserting that the opposing parties failed to address Family Sleep Services’ ownership of the incontestable registration for FAMILYSLEEP.COM. The opposing parties subsequently conceded to the motion, and the Trademark Trial and Appeal Board dismissed the opposition with prejudice. As a result of the TTAB’s decision, Family Sleep Services has obtained a federal registration for the mark FAMILYSLEEP (U.S. Reg. No. 4,333,649).
