St. Onge IP Wins ICANN Domain Transfer for Rockport’s Dunham Brand

Attorneys Stephen McNamara and Alyson DiLena were successful in obtaining an order that the domain dunhamshoes.com be transferred to Rockport, owner of the famous Rockport® and Dunham® shoe brands.  The subject domain, which was owned by a hidden Vietnamese individual whose identity was only revealed through the ICANN proceeding, was not actually selling any shoes on his website but redirecting to Amazon and profiting from Amazon affiliate commissions.  The panel found that using Rockport’s trademark to profit from links to its products on Amazon was likely to mislead consumers into believing that Rockport was associated with the website, warranting a transfer of the domain.
