St. Onge IP obtains permanent injunction for AdWeek, LLC

October 15, 2019 by in Litigation

St. Onge IP attorneys Jonathan Winter, Gene Winter, and Alyson DiLena represented Adweek, LLC in a trademark infringement lawsuit in New York against Carnyx Group and its editor Gordon Young, who operate the news site thedrum.com.  Adweek alleged that Defendants improperly used its famous ADWEEK® trademark.  Following a mediation session with U.S. Magistrate Judge Ona Wang, Defendants accepted a permanent injunction preventing further improper use of Plaintiff’s ADWEEK® trademark.  Defendants were also required to make a payment to Adweek, LLC, with the amount remaining confidential.  This follows an earlier win by St. Onge IP for Adweek, LLC in the same case where U.S. District Judge Gregory Woods issued an order denying Defendant’s motion to dismiss, explaining that Defendants had applied the incorrect legal standard for trademark infringement.

The injunction and monetary payment requirement was entered as an order on the record with Judge Wang during the mediation conference and a copy of the transcript can be found here.
