SSJR’s Successful Challenge of Audience Response And Polling System Patent by Ex-Parte Reexamination Affirmed on Appeal

In March 2007, SSJR submitted a request to U.S. Patent Office for an Ex-Parte Reexamination of U.S. Patent Re. 35,449, owned by Fleetwood Group, Inc., citing prior art references believed to render many of the claims of the Fleetwood patent unpatentable and invalid. The U.S. Patent Office agreed with SSJR and issued final rejections of all of the challenged claims. Fleetwood appealed the rejections to the Board of Patent Appeals and Interferences of the U.S. Patent and Trademark Office. The Board recently affirmed the rejections finding all of the challenged claims of the Fleetwood patent unpatentable in view of the prior art references cited by SSJR.
