In a patent application for streamlining and automating many aspects of home constructions and remodeling, SSJR’s patent prosecution team has succeeded in obtaining reversal of several key claims finally rejected by the patent examiner. After successfully convincing the Board of Patent Appeals and Interferences to reverse all rejections issued by the patent examiner in a patent application directed to an electronic document proofing system, SSJR’s patent prosecution team has issued U.S. Patent No. 6,918,082.

SSJR has filed a declaratory judgment action on behalf of Eon Labs asserting Eon’s generic version of the drug Azithromycin does not infringe two Pfizer patents covering forms of the antibiotic.

Presented at the Rochester Intellectual Property Law Association at the Rochester Riverside Convention Center, Rich Basile addresses the history and circumstances that led to the case and the historic en banc ruling. The presentation also addresses the case’s potential impact on future cases involving claims of willful infringement.
