Ms. DiLena is dedicated to fostering innovation and competition by helping clients file, enforce and litigate patents, trademarks and copyrights. She represents clients before the United States Patent and Trademark Office and in federal and state courts throughout the country. Ms. DiLena is one of the leading young IP lawyers in the U.S. and was recognized by her peers and Connecticut Super Lawyers as a “Rising Star” in 2017 and 2018.
Ms. DiLena utilizes over five years of experience as a formulator at Bristol-Myers Squibb Co. and a microbiology lab intern at Pfizer, Inc. to help generic and start-up pharmaceutical companies prepare ANDA filings – including conducting pre-filing investigations and preparing opinions and Notice Letters – navigate Hatch-Waxman litigation, and respond to pre- and post-approval inspection issues. She has removed obstacles to regulatory approval by petitioning FDA to delist patents from the Orange Book. She has been a member of trial teams which successfully invalidated patents in district court and at the Federal Circuit, enabling generic competition to greatly reduce the cost of prescription drugs to millions of patients. Ms. DiLena has also served as lead counsel in contract disputes related to development and supply of pharmaceutical products. She has experience in proceedings to collect on injunction bonds totaling over $400 million.
As a former scientist, Ms. DiLena appreciates working closely with inventors, experts, and marketing teams to prepare and prosecute patent and trademark applications. She uses her industry experience with analytical analyses, materials science, and assembly and maintenance of manufacturing equipment to draft patents in a variety of technical fields.
Ms. DiLena is regularly involved in trademark opposition proceedings before the TTAB.
Ms. DiLena works closely with foreign patent and trademark attorneys to protect and enforce client’s rights throughout the world. Her experience as a visiting attorney at a German law firm enables her to bring a global perspective to filing and enforcing intellectual property rights.
