SSJR Obtains Reversal of Patent Claim Rejections in Inter Partes Post Grant Proceeding

SSJR attorneys have secured a decision by the Patent Trial and Appeal Board (PTAB) reversing rejections of all but one claim in an Inter Partes Reexamination. SSJR’s client Sudmo Holding GmbH (Sudmo) filed suit against SPX Corporation (SPX) in Federal District Court for the District of Delaware alleging infringement of U.S. Patent No. 7,891,376 (the ‘376 patent). SPX filed three consecutive petitions for Inter Partes Reexamination relating to the ‘376 patent with the USPTO, of which all were granted. The litigation was stayed pending the outcome of the Reexamination. The Decision on Appeal confirms that claims from the original patent have survived the Reexamination. Additionally, 50 new claims that were added during the Reexamination have also been confirmed by the PTAB.
